Please read these Terms and Conditions carefully before using the www.pocockspoultry.co.uk website (the “Service”) operated by Pocock’s Poultry (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Purchases & Products

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, email address, shipping address, card payment details, and billing address.

Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including. We will take all reasonable care to ensure that all details, descriptions of Products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order.

Basis of Sales

We intend to rely on the Conditions, and they shall apply to all Contracts to the exclusion of all other terms and conditions. Please read these Conditions carefully before you submit your order to us. These Conditions tell you who we are, how we will provide Goods to you, how you may end the contract, what to do if there is a problem and other important information. Neither party can amend the Conditions without the express agreement of the other in Writing.

We shall be entitled to correct any typographical, clerical, or other error or omission in any sales literature, quotation, price list, acceptance of order, invoice or other document or information issued by us or information on the Website without any liability to you.

Any descriptions or illustrations contained in our sales literature and the Website are issued for the sole purpose of giving an approximate idea of the Goods described in them. They shall not form part of the Contract unless you confirm all the information that you intend to rely on when you place your order for the Goods and we accept your order.

The Ordering Process and Prices

Each order for Goods by you shall be deemed a Purchase of Goods subject to the Conditions.

No order placed by you shall be deemed to be accepted by us until a Written acceptance of order is issued by us in the form of a receipt or (if earlier) delivery of the Goods to you. Orders will only be accepted if there are no material errors in the description of the Goods.

Payment

Payments can be made via bank transfer; our details can be fought on the bottom of our invoices. You can also pay over the phone with one of our sales team members.

Cancellations and Refunds

If you wish to cancel or amend your order, please contact us as soon as possible via our contact request form, phone or by email.

For order cancellations, if the order is not yet out for delivery and we have been notified within 14 calendar days of your request we will cancel it immediately if requested. If you paid by credit or debit card we will refund the full amount back to the same card used to place the order. Other refund methods will be arranged as appropriate based on the original payment method.

For order amendments, if the order is not yet out for delivery and we have been notified within 14 calendar days of your request we will ask you to make a separate order for any additional products you would like added to your order. We will then refund the appropriate amount of total delivery charges paid across all orders you have placed, sending all orders in one shipment. For item removal, we will cancel and refund any items in accordance with the Terms.

If we have already sent your order for shipment, we will be unable to process any cancellations or refunds until the items are returned to us within 2 calendar days of purchase and in the condition in which they arrived to you.

Delivery

We offer next day delivery or same day delivery if orders are in before 8:00am. Any problems with delivery should be notified to us and we will use reasonable efforts to make sure that your concerns are dealt with.

Content

All of the content on our website belongs to Pococks poultry. Content on this Website may not be copied or in any other way reproduced without written permission from Pococks poultry.

You acknowledge and agree that all products, product descriptions, promotional images, logos, designs, and all other material or content supplied as part of this Website shall remain at all times the property of Pococks poultry. You are not permitted to use this material without written permission from Pococks poultry.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

Compliance with laws

The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

These Terms & Conditions shall be governed by and construed in accordance with the laws of England, and you irrevocably submit to the exclusive jurisdiction of the courts of England.

Events outside our control

We shall not be liable to you if we have delayed or failed to perform any of our obligations under the Contract if the delay or failure was due to circumstances outside our reasonable control. Circumstances beyond our reasonable control shall include, without limitation:

Pococks poultry has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Pococks poultry shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 (change this) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
